Our mission in HIGH INTELLIGENCE TECHNOLOGY FOR COSTUMER BY HORUS S.A. (HITCH) is to make available for you the information of the prices, products and places to find the product that best fits your needs and budget, as well as to have an analysis tool to make the best purchase decision at the right moment. In order to achieve our goal, this is how we operate:

We provide you with an informative, user-friendly app that allows you to identify where, what price and when the best time is to buy your products, according to your location, possibilities and greatest convenience.

We offer you the experience of comparing prices in different places so you can find your products not only in your country but in different countries, this way you can take advantage of your trips to buy your products in the country where you find the price that suits you best.

We give you the tools to make a purchase decision in which you can identify without censorship what the best place and product is to buy according to your search and preference.

We believe in your shopping experience and that is why our service platform takes each of your comments and ratings for retailers and products in the market, so that users of our service can have a real market research tool which allows them to make the most appropriate decision based on the experiences of other consumers who have already traveled the road you are about to start, which is why we show uncensored comments from users of the platform so that other users can learn about their experience. HITCH is not responsible for the comments that users make about the product, the retailer or the brand of the product.

We care about you and therefore we offer in our platform a technical support space that allows us to know your concerns about our platform and solve technical problems of the same.

We provide you with an informative app; easy to use that allows you to identify the prices available without special discounts that are applied through offers that are not available to the general public (retail price).

Introduction to Terms and Conditions

These terms and conditions which (might be modified from time to time) apply to all direct or indirect (through manufacturers or retailers) services available online, through mobile device. By accessing, browsing and using or mobile app or any of our applications available through platforms (hereinafter collectively referred to as the «Platform») you agree that you have read, understood and agree to the terms and conditions below including the privacy policy.

These Platforms, their content and infrastructure, and the service we provide on these Platforms are owned, operated and provided by HITCH and are made available to you for your personal, non-commercial (B2C) use only, subject to the terms and conditions specified below. The relationship we have with manufacturers and retailers is governed by different terms and conditions that make up the business-to-business («B2B») relationship we have with each of the manufacturers and retailers as negotiated with each of them for both the business-to-business («B2B») and business-to-consumer («B2C») relationships. Please note that manufacturers and retailers can provide, declare applicable and/or request (the acceptance of), in addition to the terms and conditions and fine print appearing on our platform, manufacturers and retailers have their own terms and conditions on which hitchme.app has no power.

Definitions

«HITCH«, «we», «us» or «our» refers to hitchme.app, a limited liability company, incorporated under the laws of Costa Rica and with registered office in the city of Heredia, under identity card of legal person 3-101- 794598. «Platform» refers to the app and the (mobile) where the Technology Market Product Information Service owned, controlled, managed, maintained and/or hosted by «HITCH» is available The term «Information» refers to the different types of products offered by technology manufacturers and retailers that can be ordered, acquired, purchased, paid for and offered at each of the technology manufacturers or retailers.

«Retailer» means the supplier of technology products (e.g., appliance stores, department stores, specialized in technology, mobile telephony operators, technology manufacturers’ stores), and any other products related to the sale of home or personal technology that, from time to time, is available on the Platform.

«Favorites» refers to products available on the online marketplace from retailers and manufacturers that you are interested in and want to add to a wish list for purchasing but have not yet decided whether it is the best option so you save it in this space for not to lose sight of it on HITCH.

«Tracking» refers to the products you are interested in and want to receive a price change alert in HITCH so you can be aware of their price change in the market.

1. Scope and nature of our Service

We HITCH provide an online Platform, by which retailers or manufacturers in their professional conduct of business, can give out, advertise, sell, promote or offer (as appropriate) their products through their websites for solicitation, purchase. And so visitors to our Platform may discover, search, compare, track or redirect to the official retailer and manufacturer website to (validate data or purchase directly from the official retailer and manufacturer website). By using the HITCH Service (e.g., by logging in to compare prices or search for product offers at retailers and manufacturers you do not establish a direct (legally binding) contractual relationship with a technology product retailer and manufacturer since our platform is purely informational, comparative and statistical pricing, product rating and/or retailers and manufacturers and not a direct product purchase site; although the platform may redirect you to the official product purchase site of a third party which has its own policies and terms and conditions. From the moment our platform redirects you to the retailers and/or manufacturers you decided to enter to make your online purchase, we act only as an intermediary between you and the retailer and/or manufacturers so that you can accurately reach the online sales link of the selected product. HITCH does not resell or offer any type of technological product, it only offers product information.

In providing our Technology Market Product Information Service, the information we display is based on the public and freely available information provided by retailers and manufacturers on their websites, so prices, adjustments, updated rates and product availability depend on the maintenance that each retailer and manufacturer gives to their website, therefore any hidden defects that retailers and manufacturers have within their websites and sales and marketing strategies are the responsibility of each retailer and manufacturer, as HITCH is a website data collection system that allows consumers to receive in an organized manner product information from the market even allowing the consumer to redirect through our platform to the official website of the retailer or manufacturer to validate the information published before making any purchase decision. While we try to make our technology marketplace product information service as accurate as possible, we cannot verify or guarantee that all information is accurate, complete or correct. We are also not responsible for errors (such as manifest and typographical errors), interruptions (due to temporary and/or partial server outages or repairs, upgrades and maintenance of our Platform or other reasons), inaccurate, misleading or false information, or lack of information. Each retailer and manufacturer is responsible at all time for their web postings and the precision, accuracy and correctness of the information on its websites (both descriptive and regarding rates/fees/prices, terms and conditions and availability). Our Platform does not constitute and should not be viewed as a recommendation or endorsement of the quality, level of service, rating or classification (by stars), type or quality of retailer or manufacturer, products unless explicitly stated or stated otherwise.

Our technology marketplace product information service is available for personal, non-commercial use only. Therefore, you are not permitted to resell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce the content, information, software, entries, products or services available on our Platform for any commercial or competitive activity or purpose.

1.1. Information to third parties

HITCH shares with its users and / or consumers, information that allows it to perform strategic analysis for the search for technology products.

HITCH is an artificial intelligence technology tool available to everyone, which allows access to comparisons, comments, suggestions and opinions quickly and effectively.

The transformation of traditional purchasing methods with the implementation and development of new technologies that facilitate each purchase process for users; has helped that currently and with the pandemic, these new technological advances are consolidated and each business has sought a way to reinvent itself to protect the health of each of the consumers and simultaneously encourage the economy.

HITCH aims to motivate the use of technology for the benefit of each user, introducing to the market new services that will allow continuity to the daily development of activities, achieving in the same way to acquire the necessary information for purchase decisions through our online platform, allowing them to know, read and share information through virtual means.

1.1.1. HITCH uses the material displayed on the public web pages of retailers and/or manufacturers for illustrative and informative purposes for the consumer. Express use is made of logos and names reducing possible risks of confusion and / or association with any other retailer listed here.

1.1.2. The reserved rights, images, texts, prices and logos correspond to the Retailer or manufacturer. HITCH in no way seeks: To sell, represent, replace, any trademark (Retailer and / or manufacturer), as well as to take any type of moral and / or intellectual right over them.

1.1.3. The data obtained for the correct functioning of the application, such as logos, prices, texts, product models; are used with the sole purpose of guiding the user in the process of finding the best place and / or product, for analysis, research or purchase decision making.

HITCH is a market research tool, applied to the consumer and / or user, which seeks information that allows you to have enough inputs to determine how and where to best invest your budget.

The extracted data processed by our consumer and/or user analysis tool; they are not used for resale and do not generate any costs; the purpose of this information is exclusive and free to use for consumers and / or users.

2. Pricing

The prices offered on each website of each retailer and manufacturer are very competitive, however, each retailer and manufacturer has its own publication policies unless otherwise stated on our Platform.

It is the responsibility of the user before making a purchase on the official website of each retailer or manufacturer to which we redirect you, ensure that the conditions and terms, thoroughly to validate that the prices and conditions of purchase of each product are correct and that the commercial offer of each retailer and manufacturer is as expected and that suits your desire to purchase.

Price histories show the price history of a product on each retailer’s or manufacturer’s official website.

We want you to pay the lowest possible price for the product you have chosen and we want other consumers’ reviews to help you make a decision based on the opinions of consumers and/or users of our platform who have already had contact with the product, retailer or manufacturer you are interested in.

Obvious errors (including typos) are not binding and do not create a right in favor of the user to claim monetary compensation.

3. Privacy and Cookies

HITCH respects your privacy. Please review our privacy and cookies policy for more information.

This is a free service for consumers using our app, only our manufacturers and retailers who wish to purchase services pay!

Manufacturers and retailers eventually, and under exclusive agreement with HITCH, will pay for advertising and trend studies. HITCH wants to improve the shopping experience of consumers or future consumers of products through the experience of platform users who have already lived the experience and share what they have lived on our platform, making their experience with a product or a retailer available to other HITCH users. In this way, consumers can make better decisions as well as manufacturers and retailers can improve the quality and service of their brands by analyzing data from the experiences of their consumers and / or users.

Through your ratings and comments, each product, manufacturer and retailer will have a real ranking according to what you as a user lived in both experiences: shopping the product and using it so that other users of our platform have enough prior analysis tools to make the best decision to questions such as where?, what? and when? to buy.

Manufacturers and retailers with available publicly prices online will appear on the HITCH platform.

4. Correspondence and communication (additional)

Once you activate notifications for price updates or technical support, you agree to receive an email, notifications or alert messages of the selected product or requested technical support in which you can receive data on price drops to products that you marked to track their price or response to your concerns.

HITCH disclaims any liability in connection with any communication with the retailer or manufacturer on or through its platform. You will have no rights to any petition, or communication with the retailer or manufacturer or (any form of) confirmation of any communication or request. HITCH cannot ensure that the retailer or manufacturer (in a due and timely manner) will receive, read, comply with, execute or accept any request or communication.

Any complaint or claim against HITCH or in regards to the information service it provides must be made immediately, or within a maximum 2-day period after identifying an error or finding any detail to file a complaint. Complaints or claims should be sent to the email mercadeohitch@hitchme.app Any complaint or claim not submitted within the prescribed time-limit may be rejected and the claimant will lose all right to any type of compensation (for damage or cost).

Due to ongoing updates and adjustments in prices and product availability, we strongly recommend taking screenshots when finding an inconsistency in order to support your argument, if necessary.

5. Ranking, stars and comments

We want to provide you search results that are relevant to you, and to do so, we offer a personalized default ranking set by our users’ previous ratings for each product on our Platform. You can browse this ranking, filter or sort by brand or product’s feature, so you can modify how the search results are presented and see the ranking ordered according to other criteria. We use various algorithms to get the results of the default ranking, and this process is constantly evolving.

Your score and comments help directly qualify the product and retailer ranking, since we want this information and qualification to have an impact and a benefit for each HITCH user; this data will not only allow to improve the performance of manufacturers and retailers with the comments and ratings that you offer on our platform but simultaneously enable manufacturers and retailers to have market studies that allow them to boost their performance and the quality of the products and services they offer to the public.

Active HITCH users can comment upon their experience in one or a few retailers when making the purchase in physical stores or online, as well as their experience with the purchased product, rate some aspects of their service and usage experience of the purchased product. Customer feedback (including submitted feedback) may be uploaded to our manufacturer or retailer information page on our platform for the sole purpose of sharing your opinion regarding the level of service satisfaction and product quality for (future) customers. HITCH can also use it (partially or completely) at its own discretion (e.g for marketing, promotion, data analysis for manufacturers and retailers to find areas for improvement based on your comments and scores regarding their products and services) on our Platform or data analysis area, apps or other communication channels used or owned by HITCH or our business partners.

In order to offer and keep the latest comments (and therefore the most relevant) each comment will only be available for a limited period, ( 3 months up to 6 months) after it is posted.

The default order for comments is sorted by submission date.

HITCH reserves the right to modify, reject or delete comments in its sole discretion, as long as they do not meet the criteria that we have established. HITCH neither compensate nor offer any type of reward to customers for completing or posting a comment. Comments are labeled as a survey and do not include any commercial sales, invitations or incentives of any kind. HITCH is committed to using the best resources to keep track and eliminate comments that are obscene, include racist or discriminatory statements of any kind or cause injury to any person or entity.

HITCH will not accept comments that:

Include obscene, sexually explicit expressions, violent, discriminatory, threatening or disruptive content.
Name specific people, or have personal attacks in general.
Promote illegal activities (e.g drugs, prostitution)
Include web pages, emails, phone numbers, credit card details.
and whose content consists of political, religious or sporting issues.

6. Liability Disclaimer

In accordance with the limitations stated in these terms and conditions, and to the full extent permissible by law, eventually and if this applies after a review of our legal department, we are only responsible for direct damages that you suffer, pay or contract as a result of defects attributable to our obligations in reference to our services, up to a total amount of the cost of your purchase.

However, and to the full extent permissible by law, neither we nor any of our directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliates, licensees, proxies, or any other people involved in the creation, sponsorship and promotion process of the website and its contents will be responsible for: (i) punitive, special, indirect or consequential losses or damages, losses of production, profits, income, contracts, as well as losses or damages of customers or reputation and losses of lawsuits; (ii) errors related to the description of information (including information about prices, availability and ratings) about retailers or manufacturers on our Platform; (iii) errors related to the interpretation of the information description (including information with regards to prices, availability and classifications) about retailers or manufacturers on our Platform, services provided or products offered by retailers or manufacturers; (iv) losses, damages or costs (direct, indirect, consequential or punitive) that you suffer, contract or pay, arising from or related to the use, unavailability or delay of our Platform; or (v) any type of harm (personal), death, property damage or other damages, losses and expenses (direct or indirect, consequential or punitive) that you suffer, contract or pay, either due to (legal) acts, errors, infractions, negligence (evident), wilful professional misconduct, omissions, breaches, misrepresentation, tortious liability or (partially or completely) attributable to the retailer or manufacturer (including any of its employees, directors, staff, proxies, representatives, subcontractors or affiliated companies ) whose products or services (directly or indirectly) are available, displayed or promoted/advertised on or through our Platform, including any (partial) cancellation, strike, unforeseeable circumstances or force majeure, or other act or situation beyond our control.

HITCH assumes no liability (and disclaims any responsibility) for the use, accuracy,validity, quality, relevance, adequacy of prices disclosure or availability of the products published and makes no representations, warranties or conditions of any kind regarding this matter, either implicit, regulatory or of any other kind, including any implicit warranty of merchantability, title, non-breach or fitness for a specific purpose. By signing these terms and conditions, you agree and accept that the retailer and / or manufacturer of the product is solely responsible and assumes all responsibility and obligation for the sale of the product, price change, promotion, advertisement and / or product guarantee. HITCH is not a product reselling platform. Complaints and claims regarding products or services (including everything related to the offered price (which may be a special offer or sale), conditions or specific requests made by Clients) must be directly submitted to the retailer or manufacturer. HITCH takes no responsibility with respect to such complaints, claims and obligations (either of the product or service).

If you have purchased directly on the retailer or manufacturer web page or purchased physically at the store, you accept that the retailer or manufacturer itself is responsible at all times for the tax collection, tax withholding, tax shipping and payment applicable upon the total price to the appropriate tax authorities. HITCH takes no responsibility for the tax collection, tax withholding, tax shipping and payment applicable upon the price (of products purchased on third-parties pages) to the appropriate tax authorities. HITCH does not act as an official seller of the products or services offered on our platform.

When it comes about uploading photos or other images to our system (for example, by submitting a comment) you certify, grant and confirm that you own or otherwise control the copyright of the photo / image and; that you agree and grant HITCH to use the photo or image on its websites (mobile), apps and promotional materials (online and offline), as well as in any publication that HITCH deems appropriate. You are granting HITCH a non-exclusive, universal, irrevocable, unconditional and permanent right, as well as the license to use, reproduce, play, replay, publish, distribute, sublicense, communicate and provide the photos / images in the way that HITCH deems appropriate.

By uploading these photos / images, the person, who provides us or uploads the images, accepts all legal and moral responsibility for any and all legal claims made by a third party (including, but not limited to, retailers or manufacturers that provide us images for uploading to our platform) as a result of the use and publication of the photos / images by HITCH. HITCH does not own or endorse in any way the photos / images that are uploaded. The veracity, validity and right to use of all photos / images provided by a retailer or manufacturer will be accepted by the person who provides us the photo or image to upload it to our platform, and it will never be the responsibility of HITCH. HITCH disclaims any responsibility or obligation with regards the publication and the photo delivered by a third party to be published. Any photo / image that does not meet the aforementioned requirements will not be published and / or may be removed by HITCH at any time and without prior notice to you.

7. Intellectual Property Rights.

Unless we indicate otherwise, the software needed for our services, available and used by our platform and the intellectual property rights (including copyright) of the content and the information as well as the material on our platform belong to HITCH and their providers.

HITCH reserves exclusively the property of all rights, tittle, and interest in (all intellectual property rights of the appearance (including infrastructure) of the Platform, where the service is available (including comments or customer feedback and original content or translated); and you do not have the right to copy, collect, link to, publish, promote, sell, integrate, use, combine or utilize the content (including translations and customer feedback) of our brand without our express written consent. Inasmuch that you want to use (completely or partially) our content (original or translated) (including customer comments) or if you are the owner of any intellectual property rights of the Platform or any other content (original or translated) even comments of clients, though this document; you transfer and grant HITCH all intellectual property rights. Any type of misuse or any type of action or behavior mentioned above will constitute an infringement of our intellectual property rights (including copyright and database rights), leading to criminal and civil penalties that take place.

9. Applicable Laws, Jurisdiction and Dispute Resolution

These terms and conditions as well as the services we provide shall be governed by and construed in accordance to the laws of the Republic of Costa Rica. Without prejudice to the legislation chosen, / Regardless of the legislation chosen, any individual who uses our services with a purpose other than professional or commercial (From now on “consumer”) can be subject to the mandatory provisions applicable to the current country of residence (this means, the provisions that, according to the regulations of every country, shall apply independently from this term of choice of law applicable; hereinafter referred to as “mandatory provisions”). Any type conflict that may arise as a result of these terms and conditions and our services, can only be resolved in the competent courts of the Republic of Costa Rica. Without the prejudice of the term of jurisdiction, a consumer may initiate legal proceedings about the application of the pertinent mandatory provisions in courts of the current place of residence; however, a process against a consumer may only be initiated in court of their current country of residence. Notice for consumers of the American Economic Area: we strongly recommend to be notified first of any claim through the customer service email: (soporte@hitchme.app) submitting a form for such effect. If this does not provide a proper solution to the problem, you may file a claim through the dispute-resolution platform of every county.

The original version in Spanish of these terms and conditions has been translated into other languages. The translated version is a translation of courtesy and it shall not be taken as official, therefore, no rights can be extracted from it. In the event of any dispute about the content or interpretation of these terms and conditions, as well as in the event of conflicts, contradictions or differences between the Spanish version and version in other languages, the English version of these terms prevails over the others and it is conclusive to the full extent of the law. You may review the English version on our platform (selecting the language) or you may request us in writing to send it to you.

If any provision of these terms and conditions is or becomes invalid or non-binding, you will continue to be bound by the rest of the provisions included, which will remain their unscathed validity. If this occurred, the invalid provision must be complied to the full extent of the applicable law and; and If possible, a similar effect to that of the invalid or non-binding provisions will be accepted, in accordance with the content and purpose of these terms and conditions.
